A television producer accused of taking more than $4.3 million in government-funded rebates and a further $10.2m in loans has lost his appeal to remain overseas.

Alexander Breingan is living in America and lost his bid to appear in court by audio-visual link.

District Court Judge David Clark ruled Breingan had to return to New Zealand to appear in court and Breingan appealed the decision to the High Court in Auckland.

However, Justice Layne Harvey dismissed the appeal.

He has pleaded not guilty and is due to appear in court at the end of the month.
