The genuineness of former Director General of Police (DGP) Tomin Thachankary’s hospitalisation during his incarceration in the disproportionate assets case needs to be examined thoroughly, the Kerala High Court has observed.
Justice A. Badharudeen had sought Thachankary’s medical records from the Poojappura Central Jail Superintendent while considering his plea for modification of his bail condition restricting international travel. Thachankary had informed the court that he was employed in the United Arab Emirates and would lose his livelihood if he did not resume work soon.
The court orally remarked that Thachankary had “10,000 ailments while in jail but was fit for a job outside the country as soon as he was released,” and that there was a “severe contradiction”. The court said it would not hesitate to cancel Thachankary’s bail if it was found necessary.
The court was informed that Thachankary was sent to the Central prison on September 17 and had remained in the prison hospital block continuosly till his release on bail on October 15. Thachankary’s clinical history showed that he suffered from coronary artery disease and had undergone coronary artery bypass graft in 2009. He was also reported to have obstructive sleep apnoea, was on continuous positive air way pressure ventilation for three years and was treated for psoriasis.
The court stated that a detailed hearing was required to find whether his hospitalisation was genuine or a gimmick played to avoid staying inside a jail cell, on par with his contention now that he is capable of working a job abroad despite his illness.
