BIhar Chief Minister Samrat Choudhary on Tuesday (October 27, 2026) ordered probe over the issue raised by Rashtriya Janata Dal (RJD) MP Sudhakar Singh with regard to defamation notice served to him by Kundan Krishnan, Director General of Police (Operation) and Special Task Force (STF) over Bharat Bhushan Tiwari police encounter case.
Mohammad Imran, Deputy Secretary at the Bihar CM Secretariat, has written a letter to the Home Department Principal Secretary for appropriate action to be taken on a letter received from Mr. Singh, concerning an impartial and independent investigation into the murder of Bharat Bhushan Tiwari, ensuring the accountability of the police command at the time, and addressing the legal notice for defamation served in connection with the raising of issues of public interest.
“As per instructions, it is requested that an inquiry be conducted or caused to be conducted. Please take an appropriate decision, inform the Member of Parliament (Lok Sabha), Sudhakar Singh, of the action taken, and provide a copy of the same to the Chief Minister’s Secretariat,”the letter stated.
Detained for six hours by Nawada Police, says RJD MP Sudhakar Singh
On June 17, 2026, Bharat Bhushan Tiwari, a young man from Bilauti village in Bhojpur district, was allegedly killed by the police in an encounter, and the incident created controversy. Later, Mr. Singh, an RJD MP from the neighbouring district of Buxar, raised questions over the “suspicious deaths” of Tiwari by the hands of policemen belonging to the STF.
On October 6, 2026, the police official sent a defamation notice of ₹5 crore to Mr. Singh for “false and disparaging statements” and sought a public apology within 15 days or face the ₹5 crore defamation suit.
On October 15, Mr. Singh wrote to the Bihar CM with regard to the defamation notice sent by Mr. Krishnan asking whether the Bihar government endorse the notice.
In the letter, Mr. Singh raised the point that according to the Central Government’s All India Services (Conduct) Rules, 1968, and the Bihar Government Servants’ Conduct Rules, 1976, any government official seeking to file a defamation suit in a matter related to their official duties must first obtain the government’s prior approval, in accordance with the prescribed provisions.
Addressing the CM, Mr. Singh wrote, “Could you please clarify whether this has been authorised by you, in your capacity as the State’s Home Minister, or by your government? Furthermore, if no such official authorisation has been obtained, I request that you ensure this gentleman receives training on government conduct rules.”
Mr. Singh further added that in the Bharat Bhushan Tiwari case, the CM and the Bihar government had acknowledged that the police committed an error and, on that basis, the concerned police personnel were suspended, an FIR was registered following a complaint by the deceased’s mother, and the government ordered a judicial inquiry.
Later on October 22, 2026, Mr. Singh replied to the defamatory notice of the police officer and wrote a letter to all MPs and MLAs, which he also posted on his social media handle X, confirming that he had received a legal notice for defamation on behalf of Mr. Krishnan demanding a public apology, threatening a defamation lawsuit, and warning of criminal action through his advocate, “because he had raised questions in the public interest.
Speaking to The Hindu, “Mr.Singh said, “Disciplinary action should be taken against him for threatening a member of Parliament. His role in the Bharata Bhushan Tiwari encounter case should also be investigated. Over the last twenty years, many IAS and IPS officers in the Bihar Government seem to have forgotten that they are servants of the public, while elected MLAs and MPs are the people’s representatives.”
Mr. Sing asserted that it has become routine for officials to disregard legislators, whether from the ruling party or the opposition.
When The Hindu contacted Mr. Krishnan, he refused to comment over the probe order.
